Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Toka Learning LLC ("Toka", "we", "us", or "our"), the operator of tokalearning.com and the associated mobile applications (together, the "Service"). By creating an account, browsing, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to create a Toka account. Toka accounts are family accounts: a parent or legal guardian ("Parent") creates the account and is responsible for any child profiles added to it. Children do not create their own accounts and do not provide personal information directly to Toka — all child profile information is entered and managed by the Parent. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

The Service lets you submit reviews, ratings, profile information (including your name, avatar, and bio), submitted resource listings, and other content you provide to the Service ("User Content"). You retain ownership of your User Content, but by submitting it you grant Toka a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute it as part of operating and promoting the Service — for example, showing your review on a resource page or in a "most helpful reviews" listing.

You're responsible for what you submit. You agree not to post User Content that is false, defamatory, infringing, or that violates another person's privacy or intellectual property rights.

In addition to the restrictions in Section 3, you agree not to submit User Content that:

• is sexually explicit, pornographic, or depicts nudity;
• contains profane, vulgar, or abusive language, or hateful, discriminatory, or harassing content directed at a person or group;
• is illegal, or promotes illegal activity or violence; or
• impersonates another person or misrepresents your affiliation with any person or organization.

Toka uses a combination of automated screening — including image analysis and language filtering applied to avatars, profile information, submitted resources, and reviews — and human moderator review to enforce this section. Content that violates this section may be rejected at the time of submission or removed afterward, and repeated or serious violations may result in restrictions on your ability to submit resources or reviews, or suspension or termination of your account, as described in Section 5.

Submitted resources and reviews are subject to review by Toka moderators before they are made publicly visible, and any review can be flagged by other users for re-review. We may remove, edit, or decline to publish any User Content, and may suspend or terminate accounts, at our discretion — including for content that violates these Terms, is reported as inaccurate or abusive, or that we determine in good faith is harmful to the community.

Toka is free to use and earns commissions through affiliate relationships with booksellers, publishers, and curriculum retailers. Resource pages and our price panel link to third-party seller websites, and some of those links are affiliate links — see our Privacy Policy for the full affiliate disclosure. We do not control, and are not responsible for, the content, pricing, accuracy, or availability of any third-party site you reach through a link on the Service.

The Service, including all reviews, ratings, and resource information, is provided "as is" without warranties of any kind. Toka does not guarantee the accuracy of reviews, seller prices, or resource metadata, and is not responsible for purchasing decisions you make based on content found on the Service.

To the fullest extent permitted by law, Toka and its officers, employees, and affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

You may stop using the Service and request deletion of your account at any time by contacting [email protected]. We may suspend or terminate your access to the Service if you violate these Terms.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the courts located in that jurisdiction, unless applicable consumer-protection law in your country of residence requires otherwise.

We may update these Terms from time to time. If we make a material change, we'll update the effective date below and, where required by law, notify you before the change takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
